Terms of Service

Please read these terms carefully before using Nevind AI. By accessing or using the platform, you agree to be bound by these terms.

1. Parties & Agreement

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Sinreh Digital, a business based in Toronto, Ontario, Canada, operating the Nevind AI platform ("we", "us", or "our").

Nevind AI is a Canadian AI platform providing AI voice reception, appointment management, lead generation, and business intelligence services. By creating an account or using any part of the platform, you agree to these Terms in their entirety.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Eligibility

To use Nevind AI, you must:

  • Be at least 18 years of age;
  • Be legally capable of entering into binding contracts;
  • Use the platform for lawful business purposes only;
  • Not be prohibited from using the services under applicable Canadian or international law.

The platform is intended for business use. Consumer protection legislation may apply where you use Nevind AI for personal non-commercial purposes, including the Consumer Protection Act, 2002 (Ontario) and equivalent provincial legislation.

3. Services

Nevind AI provides the following services, subject to your subscription plan:

  • AI Voice Receptionist — automated inbound call handling with intelligent responses;
  • Appointment Management — AI-powered scheduling, booking, and calendar integration;
  • B2B Lead Generation — discovery and outreach tooling for business development;
  • Knowledge Base — automated extraction and indexing of business information;
  • Email Re-engagement — compliant outreach campaigns to existing clients.

We reserve the right to modify, suspend, or discontinue any feature at any time with reasonable notice. Material changes to core functionality will be communicated via email at least 30 days in advance.

Service availability targets 99.5% uptime monthly, excluding scheduled maintenance. We will provide advance notice of planned maintenance where practicable.

4. Subscriptions & Billing

4.1 Plans & Pricing

Nevind AI offers monthly and annual subscription plans as described on our Pricing page. All prices are in Canadian dollars (CAD) unless otherwise stated. Applicable taxes (including GST/HST) will be added at checkout as required by law.

4.2 First Month Discount

New subscribers may be eligible for a 20% discount on their first month of any paid plan. The discount is applied automatically at checkout where offered and is valid for one subscription per account. The discount applies only to the first billing period; subsequent months are billed at the standard plan price. Promotional discounts cannot be combined with other offers unless explicitly stated.

4.3 Billing Cycle & Renewal

Subscriptions are billed in advance on a monthly or annual basis. Your subscription renews automatically at the end of each billing period. We will notify you by email before any annual renewal.

4.4 Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the platform until then. We do not prorate partial months for monthly plans.

4.5 Refunds

We offer a 30-day money-back guarantee for new subscriptions. If you are not satisfied within 30 days of your first payment, contact support@nevind.com for a full refund. Refunds are not available after the 30-day window or for renewals.

4.6 Payment Disputes

If you dispute a charge, contact us at support@nevind.com before initiating a chargeback. Unresolved chargebacks may result in account suspension. Billing records are retained for 7 years as required by the Canadian Income Tax Act, s.230.

4.7 Price Changes

We reserve the right to change subscription prices with 30 days' written notice. Price changes take effect at your next renewal. Continued use after the notice period constitutes acceptance of the new price.

5. Acceptable Use

You agree not to use Nevind AI to:

  • Violate any applicable law, regulation, or third-party rights;
  • Engage in unsolicited commercial electronic messages in violation of Canada's Anti-Spam Legislation (CASL) or equivalent;
  • Harass, threaten, or harm any individual through AI-generated calls or messages;
  • Impersonate any person or entity, or misrepresent your identity or affiliation;
  • Collect personal information without appropriate consent under PIPEDA;
  • Circumvent, disable, or interfere with platform security features;
  • Reverse engineer, decompile, or attempt to extract the source code of the platform;
  • Resell, sublicense, or commercialise access to the platform without written permission;
  • Use the platform to process health information under PHIPA without a Business Associate Agreement;
  • Generate, distribute, or process content that is illegal, defamatory, or violates third-party rights.

We reserve the right to investigate and take appropriate action, including account suspension or termination, for any violation of this section.

6. Data & Privacy

Your use of Nevind AI is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA), Quebec Law 25, and the General Data Protection Regulation (GDPR)where applicable.

You are the data controller for personal information belonging to your customers that you process through the platform. You are responsible for obtaining all necessary consents from your customers before their data is processed by our systems, including consent for call recording and AI interaction where required by law.

Enterprise customers may request a Data Processing Agreement (DPA) by contacting privacy@nevind.com.

6.1 Call Recording Compliance

You are solely responsible for complying with all laws governing call recording in your jurisdiction, including any obligation to notify callers that calls may be recorded or processed by AI. In Canada, one-party consent generally applies federally; some provinces and jurisdictions may require all-party consent.

6.2 Health Information

Nevind AI is not certified under the Personal Health Information Protection Act (PHIPA) or HIPAA. If you operate in a regulated health sector, you must not use the platform to process protected health information without a signed Business Associate Agreement and appropriate safeguards in place. Contact us to discuss your requirements.

6.3 Your Data Rights

You may export or delete your account data at any time from Settings → Privacy & Data. See our Privacy Rights page for full details.

7. Intellectual Property

The Nevind AI platform — including all software, interfaces, algorithms, trademarks, and documentation — is owned by or licensed to Sinreh Digital. All rights are reserved. Nothing in these Terms transfers any intellectual property rights to you.

Your content: You retain full ownership of all data, content, and information you upload or provide ("Your Content"). You grant us a limited, non-exclusive licence to process Your Content solely to provide and improve the services. We will not use Your Content to train AI models without your explicit consent.

Feedback: Any feedback, suggestions, or ideas you provide regarding the platform may be used by us without restriction or compensation.

8. Disclaimers

The platform is provided "as is" and "as available" without warranties of any kind, express or implied, to the maximum extent permitted by applicable Canadian law, including the Ontario Sale of Goods Act and the Consumer Protection Act, 2002.

We do not warrant that:

  • The platform will be uninterrupted, error-free, or secure at all times;
  • AI-generated responses will be accurate, complete, or appropriate for your use case;
  • The platform will meet your specific business requirements;
  • Defects will be corrected within any specific timeframe.

AI systems may occasionally produce incorrect or incomplete responses. You are responsible for reviewing AI outputs and not relying solely on them for consequential business decisions.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Sinreh Digital and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunities, arising from your use of or inability to use the platform.

Our total aggregate liability to you for any claim arising under or related to these Terms shall not exceed the greater of:

  • The amount you paid us in the 12 months immediately preceding the claim; or
  • CAD $100.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law, including under applicable Canadian consumer protection legislation.

10. Indemnification

You agree to indemnify and hold harmless Sinreh Digital and its personnel from and against any claims, losses, damages, and expenses (including reasonable legal fees) arising from:

  • Your violation of these Terms;
  • Your use of the platform in a manner not authorised by these Terms;
  • Your violation of applicable law, including CASL or PIPEDA;
  • Any claim by your customers or third parties arising from your use of the platform.

11. Termination

By you: You may terminate your account at any time from Settings → Privacy & Data → Delete Account. Termination does not entitle you to a refund except as provided in Section 4.5.

By us: We may suspend or terminate your account with immediate effect if you materially breach these Terms, engage in fraudulent activity, or if continued operation poses a risk to other users or the platform. We will provide written notice where practicable.

Upon termination, your right to access the platform ceases immediately. You may request a data export before termination. Sections 6, 7, 9, 10, 12, and 13 survive termination.

12. Disputes & Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada. You waive any objection to venue or jurisdiction in Ontario.

Before initiating legal proceedings, you agree to first contact us at contact@nevind.com to attempt to resolve the dispute informally within 30 days.

Nothing in this section affects your statutory rights under Canadian consumer protection legislation or your right to file a complaint with the Office of the Privacy Commissioner of Canada (OPC) or the Commission d'accès à l'information (CAI) for privacy matters.

13. Anti-Spam — CASL Compliance

Nevind AI's email re-engagement features are designed for use in compliance with Canada's Anti-Spam Legislation (CASL), S.C. 2010, c. 23. As a user of these features, you represent and warrant that:

  • You have obtained valid express or implied consent from each recipient before sending commercial electronic messages (CEMs) through the platform;
  • Each CEM contains accurate sender identification, a valid mailing address, and a functioning unsubscribe mechanism;
  • You will honour unsubscribe requests within 10 business days as required by CASL;
  • You maintain records of consent for a minimum of 3 years after the consent was obtained.

You are solely responsible for CASL compliance in your campaigns. Nevind AI provides technical unsubscribe infrastructure but cannot verify the legal basis for your recipient lists.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email and by posting the updated Terms on this page with a revised "Last updated" date at least 14 days before changes take effect.

Your continued use of the platform after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using the platform and cancel your subscription before the effective date.
